Pretrial Detention & Bond — Florida Statute 907.041

Florida Statute 907.041 controls whether you sit in jail or go home while your case is pending. It starts from a presumption in favor of release on nonmonetary conditions — but that presumption disappears fast when the charge is on the “dangerous crime” list.

The list includes arson, aggravated assault, kidnapping, homicide, sexual battery, robbery, and burglary of a dwelling, among others. A dangerous-crime charge changes the bond posture of the entire case.

When the state can hold you without bond

The state attorney can move for pretrial detention — no bond at all — on grounds such as: prior violations of release conditions, threats to victims or witnesses, drug trafficking charges with a substantial probability of guilt, or a showing that you pose a threat of harm to the community. The burden is on the state, the hearing must happen within 5 days, you have the right to counsel and to cross-examine witnesses, and the court must issue findings within 24 hours.

The detail most people miss

The first-appearance bond is not the final word — it is the opening number. A properly litigated bond motion with employment records, family ties, and residence history routinely moves bonds substantially. (In capital and life-felony cases a different track applies — the Arthur hearing.) The worst mistake is waiting weeks in jail before anyone files anything.
